1. Acceptance of Terms

Welcome to SOMOGY. By accessing or using our services, including our Translation Tool and Analytics Dashboard, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and SOMOGY, a company registered in the Netherlands.

2. Description of Services

SOMOGY provides the following services:

• Translation Tool: An automated product translation service designed for e-commerce businesses to translate product descriptions and content into multiple languages.
• Analytics Dashboard: A data analytics platform integrating with Looker Studio to provide insights into your e-commerce performance, website traffic, and business metrics.

3. User Accounts

To access our services, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our services.

4. Subscription and Payments

Our services are offered on a subscription basis. By subscribing to our services, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis
• All payments are processed securely through Mollie, our payment service provider
• Prices are displayed in Euros (EUR) and include applicable VAT where required
• You authorize us to charge your payment method for recurring subscription fees
• Subscription renewals occur automatically unless cancelled before the renewal date

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with the proper functioning of our services
• Use automated systems to access our services beyond approved API usage

6. Intellectual Property

All intellectual property rights in our services, including software, designs, trademarks, and content, are owned by SOMOGY or our licensors. You are granted a limited, non-exclusive, non-transferable license to use our services for your business purposes.

You retain ownership of any content you submit to our services. By submitting content, you grant us a license to use, process, and store that content as necessary to provide our services.

7. Data Protection and Privacy

We are committed to protecting your privacy and personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch data protection laws. For detailed information about how we collect, use, and protect your data, please refer to our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• SOMOGY provides services "as is" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you for the services in the twelve (12) months preceding the claim
• We do not guarantee the accuracy of translations produced by our Translation Tool and recommend professional review for critical content

9. Termination

You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account if:

• You breach these Terms
• You fail to pay subscription fees
• We are required to do so by law
• We discontinue the services

Upon termination, your right to use the services will immediately cease. You may request export of your data within 30 days of termination.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our services. Continued use of our services after changes become effective constitutes acceptance of the modified Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Utrecht, Netherlands.
